Mumbai The Bombay High Court has permitted a 19- time-old boy tore-appear for the enhancement test for Class XII that he couldn't answer last time as he was suffering from depression and Internet Gaming complaint. A division bench of judges A S Chandurkar and Rajesh Patil, in its order of July 4, said the boy deserves to be given an occasion to appear for the enhancement test for his Advanced Secondary Certificate( HSC) in the interest of justice.
In his plea, the boy said he was always an below average pupil and used to secure 85- 93 percent marks till Class XI. still, when he appeared for his Class XII examination in March 2023, he was suffering from depression and, therefore, managed to get just 316 marks out of 600, the plea said. The petitioner claimed he was under treatment for depression and anxiety from July 2023 till December 2023.
The plea said he also passed treatment at the Bhabha Atomic Research Centre Hospital, adding he was diagnosed with Internet Gaming complaint due to which he couldn't appear for the reappraisal held in July 2023. The supplicant said he approached the High Court after his request to appear for the enhancement test to be held in March 2024 was refused by the council.
In the plea, the boy said another enhancement test is listed for July 16 this time. The bench, after poring the medical reports of the boy, said he was witnessing treatment for Internet Gaming complaint. “ The authenticity of the documents isn't misdoubted. In the peculiar data of the case, we find that an occasion deserves to be granted to the supplicant to seek enhancement in his marks since he was forestalled from doing so before for medical reasons.
In our view, the medical papers substantiate the supplicant’s plea that he was unfit to take the said examination before, ” the HC said. “ In the interest of justice, subject to the supplicant making the needful operation seeking authorization to appear in July 2024 examination with the council, coupled with payment of necessary late freights, he shall be permitted to appear in the examination that's to commence from July 16, ” the HC said.
