Allahabad High Court: There have been many such cases in the court of divorce and subsequent alimony dispute. But a case was filed in the Allahabad High Court. A family court in Uttar Pradesh has ordered a 75-year-old woman to pay a monthly maintenance of Rs 5,000 to her 80-year-old husband. She challenged the decision in the Allahabad High Court. When the case was being heard in the High Court, the judge said that if the battle of alimony had to be fought at this age, then this should be the Kali Yuga.
What's the case?
Munesh Kumar Gupta has approached the High Court against his wife. He had built the house in 1981 in the name of his wife Gayatri Devi. After the marriage, the girl went missing. In 2005, Munesh retired from his fourth grade job in the health department. In 2008, Gayatri Devi gifted her house to her youngest son. The elder son did not give anything, so there was a bitter quarrel between the elderly couple.
After this, both of them started living separately. Gayatri Devi filed an application in the family court against Munesh Gupta and sought alimony. Notably, the family court ruled in their favour and ordered Munesh to pay Rs 5,000 per month.
Munesh Gupta's counsel told the high court that in 1981, Gupta built a house in his wife's name. In 2007, Rs 1 lakh received after retirement was deposited in the name of his wife. Later, she was given Rs 2,000 per month. His wife has started a small shop in the house. The wife and the younger son drove the elder brother and Munesh Gupta out of the house. He then demanded that Rs 5,000 be given from the pension of Rs 13,740. That's illegal.
What did the Supreme Court judge say?
Judge Shyam Shamsheri said the legal rivalry between the elderly couple was worrisome and he tried to counsel both the elderly. He also hoped that by the next date of hearing, both of them will resolve something by mutual consent.
